Role of Entrepreneurship and Innovation Essay They have employed existing means of production differently, more appropriately, more adventurously. They have â€Å"carried out new combinations†. They are entrepreneurs† – Joseph Schumpeter (Lumsdaine and Binks, 2007). Entrepreneurship is a procedure through which individuals identify opportunities (problems that need to be solved or unmet needs) in the market place, allocate resources, initiate change by being innovative and creative and create value through solutions. One of the Factors of Production to produce goods or services is Enterprise with Land, Labour and Capital; an entrepreneur combines all other factors of production by enterprise, which is actually problem solving, risk taking and creativity, to come up with innovative products or services. â€Å"Innovation is the ability to see change as an opportunity not a threat†. (Steve Jobs,2010). It is not necessary that Innovation is something completely new which is stated as ‘Discrete Change’ by Joseph Schumpeter, it can also be a ‘Gradual Change’, that is a product or service which is better than what was there before (Lumsdaine and Binks, 2007). It can be called a process by which an Idea or invention is translated into a product or service for which people will pay and perceive it as being new. Entrepreneurship is incomplete without Innovation as Steve Jobs said, â€Å"Innovation is the specific instrument of entrepreneurship. The act that endows resources with a new capacity to create wealth. †. (Steve Jobs,2010). Economic Development can be defined as the development of economic wealth for the well being of a country’s inhabitants. It implies progressive changes in the socio-economic structure of an economy, change in the distribution pattern of income, adoption of new technologies, creation of jobs, transition from agro-based to industry-based economy and general improvements in living standards. According to Lumsdaine and Binks,â€Å"In the context of entrepreneurship, it is creativity that leads to Innovation, that is development of new products and processes which when innovated replace the traditional and previous versions. Creativity leads to a greater fulfillment on an individual basis as we use our imagination to create our new horizons for what we do in our lives. By imagining what we could be and achieve, we move beyond the boundaries we have previously set for ourselves. Innovation can be seen as practical application of creativity in an organization. † (Lumsdaine and Binks, 2007) So Innovation is actually the product of Creativity and Problem Solving with the help of Entrepreneurship. â€Å"Entrepreneurs are the catalysts that spur the economy with their innovations and technological change† – Joseph Schumpeter (Lumsdaine and Binks, 2007). Entrepreneurship leads to Economic Change and economic development through creative destruction. When the Entrepreneurs sell their Idea, the Idea is a solution to a problem and is a need that has not been met before which means there was a gap in the market for that product or service which he innovated, consumers buy it because there is a demand for it which the entrepreneur realized and innovated it and as more and more consumers buy it, more will be the improvement in Living Standards of the inhabitants of the Economy; in conclusion, entrepreneurs showing their creativity solve a problem and innovate a product or service which benefits the economic development of an economy directly and indirectly. Wal-Mart Stores is a relevant example for understanding the relationship between Entrepreneurship, Innovation and Economic Development, the company which is ranked no. 18 in the Forbes List of â€Å"Global 2000 Leading Companies 2011†. Samuel Moore Walton is one of the most successful entrepreneurs who made it possible in less than half a century. He founded the Company in 1962 when he opened the company’s first discount store in Rogers, Arkansas, USA after watching a market gap of Discount stores in his State of Arkansas. He just figured out a problem that people in the urban areas have to pay higher prices at stores in the city center since the country side is far away for the consumers to go there and the stores used to take an advantage of that and charge higher prices. Sam Walton imagined using his creativity, what if there is a discount store in the city which buys everything in bulk from the country side and uses its own transport for delivery of good to the store, would the consumers buy from there at lower prices rather than going to other stores in the city with higher prices. He just used his creativity to solve the problem and Innovated world’s first and most successful Discount Store, Wal-Mart. Sam Walton, in his autobiography, said, â€Å"If you think about it from the point of view of the customer, you want everything: a wide assortment of quality merchandise; the lowest possible prices; guaranteed satisfaction; friendly, knowledgeable service; convenient hours; and a pleasant shopping experience. You love it when a store exceeds your expectations, and you hate it when a store inconveniences you, gives you a hard time, or pretends you’re invisible. (2011). When he opened his first Wal-Mart store, no one imagined he was introducing a retailing formula that within a generation would impact the lives of millions of people. Wal-Mart Stores grew gradually but at a good pace and then reached to the position it has achieved today. In 1975, it employed only 7500 employees, 125 stores with Sales of $340 billion. In 1983, The Forbes Magazine ranked it no. 1 General retailer for the eighth year straight. In 1991, Wal-mart became an international supermarket chain with more than 1200 stores and more than 200,000 employees. Wal-Mart launched Sam’s clubs which was also a success and reached 1995 stores, 239 supercentres, 433 Sam’s Clubs and 276 international stores with 675,000 employees by the end of 1995. By 1997, Wal-Mart Stores had entered into another part of the world, which is China and was taking Environmental friendly measures and also became the largest private employer in the US with 680,000 employees and additional 115,000 international employees serving 90 million customers per week worldwide. By the end of the 1990s, Wal-Mart had opened stores in Korea and Germany and had become the largest private employer of the World with total of 1,140,000 employees. By 2004, Wal-Mart had been declared as the third most admirable company in the US by Fortune Magazine, ranked among the companies with â€Å"Top 25 Diversity Recruitment Programs† and was awarded the â€Å"Corporate Patriotism Award†. In 2005, The Wal-Mart Foundation started working much actively and donated $18 million for US hurricane relief efforts and the Company employed more than 1. million employees and owned 3800 Stores in the US and 3800 International Stores with Annual Sales of $312. 4 billion and existed in 16 countries. Today, Wal-Mart Stores owns 9826 stores in 28 countries with 2. 1 million employees and serves more than 176 million customers annually. Walmart Foundation now is too active and donates largely in relief efforts and for causes; it has separate programs for different fields like Health, Disable people and Education (Wal-mart Stores, 2011). Sam Walton said it best, â€Å"If we work together, we’ll lower the cost of living for everyone†¦we’ll give the world an opportunity to see what it’s like to save and have a better life. † (2011). This was the innovation mainly in his Idea of Discount Stores to save people’s money, to help them live better was the goal that Sam Walton envisioned when he opened the doors to the first Walmart (2011). If his vision was to help people live better which means improving their living standards, then there is no doubt that how much Wal-Mart would have contributed towards positive economic development just because of Sam Walton’s entrepreneurship and Innovation. A company that employs 2. 1 million people cannot be questioned for its contribution towards economic development. Since it generated a lot of employment opportunities the economy was benefited in the form of expenditure on goods and services by the employees; moreover, all the employees working there earn a salary from Wal-Mart and then spend it on goods and services in their own economies. Expenditures like education and health increase the demand of goods and services in the economy leading to economic growth. This has lead to increase in the economy’s PPF outwards as A. D of the economy has increased. On the basis of the figures provided in the 2010’s Annual Report of Wal-Mart Stores and the World Bank’s statistics of the US’s GDP of the year 2010, Wal-Mart Stores had contributed approximately 2. 8 percent to the Annual GDP of the US in 2010. (Yahoo Finance and World Bank, 2011). This Calculation can be supported by the Statistics provided by the website of Wall-Mart Stores, that in 2010, Wal-Mart’s sales were $307. billion in U. S. retail sales as the  next five largest U. S. retailers combined  sales of $324. 5 billion: Kroger ($78. 3 billion), Target ($65. 8 billion), Walgreen ($61. 2 billion), Home Depot ($60. 1 billion) and Costco ($58. 9 billion). In 2005, almost half (46%) of Americans lived within 5 miles of a Walmart or Sams Club, and 88% lived within 15 miles of a Walmart of Sams Club which also shows the contribution of Wal-Mart towards U. S. ’s economy and in 2011, every $45 dollars spent in the U. S. economy, almost $1 was spent on a purchase at a Walmart. (Wal-mart Stores, 2011). Therefore, the presence of Wal-mart in the US economy generated income not only for the employees but for the economy as a whole. Among all of the great scholars of entrepreneurship, Joseph Schumpeter is the only one who has explained properly the relationship between Entrepreneurship, Innovation and Economic Development. According to Lumsdaine and Binks (2007), â€Å"The crucial contribution made by Joseph Schumpeter in The theory of Economic Development (ref. 2. 1) was to highlight the entrepreneur’s role as the catalyst for economic development. This contribution connects entrepreneurship, creativity and economic development. To understand the actual and potential impact of entrepreneurship, it is important to consider his analysis. Schumpeter portrayed any economy as a collection of enterprises and business where each represented a particular combination of production factors in the form of machines, people, land, premises, finance, and so on, in some sense every business relied for its market upon the successful activities of all others. This interdependence through customer demand meant that changes in the nature or level of economic activity would be caused only when a new combination of factors of production was introduced. The diverse operations of Walmart did not only benefit the US but has also contributed to economic development of under-developed and developed countries of Africa. According to Brown and Sander (2007), large multinational supermarket chains are rapidly expanding in developed and developing economies. These supermarket chains tend to import agriculture products from developing and under-developed economies; this is due to the advantage developing and under developed countries offer them in quality and prices. Which in a way is good for the development of the under developed and developing countries. According to Brown and Sander (2007), â€Å"In the continent of Africa, where small farmers account for both 90 per cent of agricultural production and 73 per cent of Africa’s rural poor, access to valuable international markets could play a crucial role in wider poverty reduction†, most Multinational Supermarket chains buy Fruits and Vegetables from small holder farmers of Sub-Saharan Africa which also increases exports of these poor countries resulting in higher economic development of their country by improvement in their living standards. According to Stokk (2007), â€Å"Supply chain development initiated by supermarkets can help farmers escape the low productivity trap. Supermarkets face a short run cost, but gradually benefit from the agricultural skill upgrading in terms of increased market share. Our result suggests that when farmers do not meet the required standards, supermarkets have an incentive to invest in farm assistance programs that improve the productivity of local suppliers. Supermarket expansion not only affects farmers in the supply chain, but also has consequences for the rest of the food retail sector. Traditional retailers face increased competition and potential loss of market share, but may benefit from foreign supermarkets through spillover effects of the latest retail techniques. † (2009). Higher productivity and latest retail techniques do affect the economic development to a great extent. In the same article Stokk said, â€Å"The value of local purchases made to operate the Wal-Mart stores and facilities such as tilities and business services. The value of goods sold by local manufacturers to Wal-Mart, The types of Wal-Mart facilities present within the MSA (Metropolitan Statistical Area), while the price effects from retail stores can be significant, other facilities such as distribution centers can also have positive economic impacts. † In conclusion, this essay has clearly analysed the relationship between entrepreneurship, innovation and economic development and has also briefly explain the role Creativity and Problem Solving play in this relationship. In this relationship between entrepreneurship, innovation and economic development, Innovation is the base, since economic development is influenced by entrepreneurship through Innovation. However, it is not necessary that all entrepreneurs benefit the economic development; it can only have a positive implication on economic development if there is innovation. And for innovation to effect the economic development positively with entrepreneurship, the entrepreneur should be creative in problem solving. Creativity is a foundation of this relationship and problem solving is an essential tool for this relationship to come over difficulties and carry on with the flow from entrepreneurship to positive economic development through innovation. However, long term economic development cannot lack of innovation and entrepreneurship, simultaneously, as tools of innovation, creativity and problem solving play a vital role in the whole process. Increased rate of crime and the refusal by the relevant state authorities to expand the number of correctional facilities has put a strain to the existing prisons. This has been recently been revisited in the national forums with calls from the concerned stakeholders to address the situation before it gets out of hand. Overcrowding according to prison authorities has reached peak levels to an extent that inmates are forced to share cells. This is an interesting topic and I plan to invest a lot of my time to expound more on the existing information. Analysis Of Aircraft Maintenance As everyone knows, nowadays aircraft has become the most important transportation for everything. But the most important is people who are travelling with aircraft. The lives of the people on the aircraft are important. Each and every airlines in this world today, are trying to convince people that they are the safest airliner, but the main question is, are they really safe as what they mentioned? Aircraft maintenance activities are generally divided into two categories, which are, working on-aircraft and working off-aircraft. Working on-aircraft is when the technician or the engineer has to troubleshoot, repaired, overhauled and changing parts. While working off-aircraft is when there is any parts on the aircraft been removed and need to be checked separately from the aircraft, for example aircraft battery check, which needs to be removed and taken to battery shop in order to continue inspection or charging. Normally, every approved maintenance organization must have store department that use to receive and issue every parts, component and appliances. For that reason, this store department must comply with storage regulations as stated in approved maintenance organization requirements such as EASA Part 145.A.42 and CAA CAP 562 Civil Aircraft Airworthiness Information and Procedures (CAAIP) recommendations. Aircraft is not like other transportations, everything parts that being installed on the aircraft must be genuine, neither like car, it can use a fake parts in order to safe cost. But aircraft is nothing close to that. If fake or bogus parts are being used on the aircraft, every person lives on that aircraft are in jeopardy. But today, the news of civil aviation authority and aircraft manufacturers are working hard tracking down and eliminate counterfeit parts as well as tracing aircraft parts which are lacks of documentation are all over the world. In this assignment a research, analyse, and critically evaluate of maintenance practices in a civil commercial aircraft environment, concerning the use and control of genuine and non-genuine (bogus) spare parts for aircraft use will be carried out. TERMS AND DEFINITIONS These terms and definition is taken from FAA unapproved parts investigation in accordance with the source from FAA (2011) and M. Mohamad (2003). BOGUS PARTS: Describe several parts categories, ranging from properly manufactured parts lacking required documentation to defective and deliberately counterfeited parts.Under FAA regulations, all aircraft UNAPPROVED PARTS: parts manufactured without FAA approval (specifically FARs Part 21.305 or repaired under the terms of Part 43) are unapproved parts. This catchall classification includes counterfeit parts, stolen parts, production overruns sold without authorization, parts in exceedance of their time limits, approved parts improperly returned to service, and fraudulently marked parts, or parts which have no traceability. COUNTERFEIT PARTS: Parts made of inferior properties. APPROVED PARTS: production standards (FAR 21.305). They can be approved under a Parts Manufacturer Approval (PMA), under Technical Standard Orders (TSOS), in conjunction with typecertification procedures through FAA administration approval, or by conforming to recognized Industry specifications. LIFE-LIMITED AND TIME-EXPIRED PARTS: Aircraft parts that have predetermined service lives become timed out and no longer serviceable after exceeding these prescribed limits. Illegal use of scrapped, time-expired critical parts, which do not have to be destroyed prior to disposal or sale as scrap, has been linked to several fatal aircraft accidents. APPROVED MANUFACTURER There few things an orgnanisation must look in before making parts order. This is to prevent from making order from fake manufacturer. The organisation must make sure the part from the manufacturer is approved by FAA or EASA under 14 CFR Part 21 and EASA Part 21. An approved part manufacturer must be certified as FAA-PMA (FAA-Part Manufacturer Approval) or EASA Production Organisation Approval (POA). According to the FAA web page under Suspected Unapproved Part (SUP) Program (FAA, updated 19 December 2008), the buyer or any organization who want to order parts can refer all the current approved PMA from the FAA database. According to CAA CAAIP Part 1 Leaflet 1-6 (2006:1), unapproved aircraft parts or materials classified if: Parts or materials not conform to an approved type design. Parts or materials fail to conform to declared specification or accepted industry standard (standard parts). Parts or materials marked by unauthorised source with false documentation. Parts not been maintain, overhauled or repaired in accordance with the requirements of approved airworthiness data and/or statutory requirements, or by persons not authorised to perform and certify those functions. Parts that directly shipped to the end user by manufacturers, suppliers or distributors who do not hold appropriate production approvals and not been authorised to make the direct shipment to user by Type Certificates holder. While for an approved parts buyer were advised and recommended to follow the minimum procedures prior to place any order of aircraft parts which According to FAA Advisory Circular AC 21-29C (2008:1) has mentioned the term of approved parts are produced in accordance with the means outlined in Part 21. The procedures that the buyer needs to follow are as below. Identify the distributors and/or suppliers including their documentation system and receiving inspection system meet the traceability of parts to an FAA approved source. Evaluate and cross-checked to unfamiliar distributors and/or suppliers in order to prevent from putting the aircraft parts into risk condition. Identify the significant reduce of price than the priced quoted by other distributors and/or suppliers of the same part. Identify the delivery schedule offered to other distributors and/or suppliers (when the stock of a like item is exhausted). Usually the bogus manufacturer offer shorter delivery. Sales quotes or discussions from unidentified distributors that create the perception that an unlimited supply of parts, components, or material is available to the end user. A bogus distributor and/or suppliers inability to provide substantiating documentation that the part was produced in accordance to an FAA approval, or inspected, repaired, overhauled, preserved, or altered in accordance with the CFR. Any parts, components or appliances that need to be released must has come with Statement of Conformity or Authorised Release Document which signed and stamped by an authorised personnel from the approved manufacturer. Besides all the above, the approved manufacturer must also include or have Export Certificates of Airworthiness stated under 14 CFR Part 21 Subpart L Export Airworthiness Approval by releasing FAA Form 8130-3 Airworthiness Release Tag for export. Advices from the authorities, have mentioned clearly to the buyer to put extra caution on choosing the aircraft part dealers and before attempting any purchase order. On 21st January 1992 the FAA had issued an Airworthiness Directives AD 91-24-14 (Transport Airplane Directorate Designee Newsletter, 1992:10), about the incident of Pratt Whitney JT8D series turbofan engine regarding the bogus 4-1/2 bearing seal spacer found by United Airline mechanic during routine maintenance inspection. The FAA had find out that bogus spacer was contributed to engine bearing seal deterioration and cause the engine failure which can put the flight jeopardy. Therefore all the buyer and part manufacturers must be alert on recommendation of the authority in terms or avoiding bogus part or fake part to be used on aircraft. COMPONENTS DELIVERY Choosing the approved part manufacturer is one thing. The other crucial part that any organization or part manufacturers need to look into is the components delivery. Whenever order is placed, it must be distributed by the standard couriers that have good reputation in delivering goods. The organisation or part manufacturers must make sure the components distributor or courier is recommended by both parties in order to confirm the security of the components delivery. In accordance with CAAIP (2009:6) Part 1 Leaflet 1-12 The Acceptance of Aircraft Component under point 5: Distributor, the aircraft component distributors are not required to be approved by the CAA. The components distributor also cannot raise the Authorised Release Document, not required to provide any technical expertise to confirm the status of the aircraft components. So, any component received from the distributor, it is the storage department which is end user who is responsible to request the Authorised Release Document that release by approved organisation and establish the acceptability of the components itself before any installation of the part to the aircraft can be made. There is also Other thing that can happen such If the original distributor doesnt want to pass the components documents to end user, if this happened it is acceptable if another distributor endorsed the original distributors documentation according to reference number given. Authorised Release Documentation of the aircraft component is on file, Ref. No. # # # # and will be made available to the end user upon request from that end user (CAAIP Part 1 Leaflet 1-12, 2008:6) A further advice by CAA CAAIP Part 1 Leaflet 1-6 (2006:1), if the parts are delivered by direct shipment from manufacturer, it has got to have an authorisation letter by the Type Certificates holder to do so. If any parts are shipped to the end user by direct delivery from the manufacturers, who do not hold appropriate production approval, it will then be declared as bogus parts or unapproved parts. In accordance to Advisory Circular 00-56A (2002:12), the distributor must have Distributors Certification Letter in order to improve the eligibility of the aircraft parts and products for installation to type-certificated products. This organisation is part of FAA agency that works to conform and audit the quality system of the distributor accordance to FAA recommendation. By doing this, the security of the parts delivery will be achieved in order to reduce the bogus part usage. ACCEPTANCE OF PARTS Following to the store requirements, the organization must show how they going to guarantee that all the parts received are genuine (ICAT Module 10:63). For that reason the organization must ensure all the parts are from approved source that has traceability and history. In 1992, according to the bogus part cases, FAA had mentioned to the aviation communities to be alert on current issue in Aviation Maintenance Alerts (FAA, updated on 25 April 2008). The purpose of this maintenance alert is to share any information about the current maintenance experiences especially about the bogus parts usage in order to improve aeronautical product durability, reliability and safety. Now days lot of bogus parts that looks similar to original parts. So the organisation need to be alert on this kind of situation in order to make sure only approved parts are install or use on the aircraft. STORE As an approved organisation, there are two types of store must be existed which are quarantine store and bonded store. Both storage stations must be separated in order to prevent from mixing up the serviceable and unserviceable items. Further explanations of both stores are as below. Bonded store In this storage area, all the parts are ready to be installed to the aircraft and being monitored on its shelf life and eligibility. Some organisation has placed the approved parts under their own storage reference. This way is easy to keep track the parts eligibility and all the documents can be managed in a better way. If any of the parts are issued from this storage area, it is the responsibility of the mechanic or the engineer to check the parts and appropriate documents in order to confirm its airworthiness before installed to the aircraft. This maintenance practice can help reduce the bogus parts from being used. Quarantine store All new materials which have been received from the distributor must be placed in the quarantine store first, at which time the stores inspectors will check that all items are received. Below are the procedures that need to be carried out by the store inspectors. The inspector must confirm the specification and the drawing requirements. Inspector must inspect in order to ensure the goods received are free from damage or corrosion Inspector must also noticed that the items are received with sufficient time left to enable the item to be stored for a reasonable period in the case of shelf life item The store inspector must ensure the items received are accompanied by necessary airworthiness certificate When all these procedure has been carried out and the store inspectors are satisfied, that the incoming spares are fully airworthy they will then produce a good receipt number to the item for company internal identification and traceability. All items with the serviceable tag are sent to the bonded store. Parts which are considered to be airworthy will stay in quarantine store until instructions are received for their handling. INDENTIFY AND HANDLING BOGUS PARTS According to Federal Aviation Administration (FAA) system surveillance and analysis division, every organisation or distributor should create procedures before purchasing parts in order to found qualified suppliers authorized to make or move FAA approved parts. The following criteria can help identify and screen out potential SUPs suppliers: 1. Lowball prices if the price quoted or advertised is significantly lower than the price from other suppliers of the same part; 2. Suspiciously fast service if the delivery schedule for an out-of-stock part is significantly shorter than from others; 3. Data shortage if the supplier seems unable or unwilling to substantiate conformity of the part; 4. Papertrail shortage if the supplier seems slow, or unable to document FAA approval for the part. If any of these types of situations arise, organization or distributor should: Inspect product containers for damage, another suppliers name, or no markings at all; Crosscheck purchase orders with the delivery receipts for proper part number or component history card; Develop a system for tracking the shelf or service life of parts so as not to inadvertently use a part with an expired life limit; Verify that part identification markings arent altered or otherwise tampered with things like a serial number stamped over, an improper label, a missing label or a serial number stamped at a spot different than usual; Inspect parts for visual defects or abnormalities, such as altered or unusual surface finishes, the absence of, or variation in, required plating, any evidence of prior use, new paint, old scratches, pitting, corrosion or any sign of an attempted repair; Audit your supplier to ensure they establish and maintain the quality requirements specified in the purchase order. The CAA and FAA will exchange this report and work together in order to trace the unapproved manufacturers. This report will support the users to be more concern about the non-genuine parts besides helping the authorities to prevent from the non-genuine parts to be installed or used for aircraft. FAA RULES AND REGULATIONS. 1. FAA Part 21 Section L Export Airworthiness Approval This approval is issued for new or used aircraft manufactured according to Subpart F and G meet the airworthiness requirements outlined in Subpart H. An export airworthiness approval for an aircraft is issued in the form of an export certificate of airworthiness. This certificate does not authorize operation of that aircraft. The FAA prescribes the form and manner in which an export airworthiness approval for an aircraft engine, propeller, or article is issued. Under this subpart also provide the responsibilities for the exporters which all documents specified must be forwarded to the country or jurisdiction. Advisory Circular 00-56A: Voluntary Industry Distributor Accreditation Program This advisory circular provides information about the system of accreditation of civil aircraft parts distributors by the FAA. The information in this AC has been revised in order to meet current changes in regulatory requirements and industry practices thus to improve the ability of certificated person to establish the eligibility of parts and products for installation on type-certificated products. Under this AC also provide the guideline for the aircraft parts distributors to be accredited thus reducing the problem of non-genuine aircraft parts in delivery system. All the accredited distributors will be given a certification letter or certificate approved by Accreditation Organisation. 3. Electronic use of the Authorised Release Certificate, FAA Form 8130-3, Airworthiness Approval Tag According to FAA Order 8130.21G (2009:5-1), under this topic the FAA provide guidance on acceptance and use of the electronic exchange FAA Form 8130-3 use of such electronic documentation for aircraft products and articles. This electronic FAA Form 8130-3 and other corresponding EASA and TCCA forms offer several advantages over the current paper format. FAA also provides information in procedures for use of this electronic 8130-3 Form. The authorised person must follow all the guidelines and notify their geographic FAA office before implementing the electronic form according to chapter 2, 3 and 4 of this order. There are high hopes for the future of our schools to take advantage of this growth and use them regularly in the classroom. The generations of students today are growing up using the computer. "Ordinary" Women in Early Twentieth Century Southern Arizona: Lives that Shaped the Frontier Experience Some historians have argued that women’s roles in early 20th century Arizona centered exclusively around the domestic sphere and typified values of femininity such as passivity, motherhood, and loyalty to marriage. Their journeys to the West are likewise portrayed as involuntary and life on the frontier a hated struggle. Branch, â€Å"If there is a moral to the history of the westwa rd movement, it is this: the transcendent importance of small things and of unimportant people† (Branch in Poling-Kempes, xii). This is especially relevant to women’s history in that women’s experiences are often ignored in dominant discourse and their achievements are relegated to the invisible sphere of domesticity. This essay will explore the ways in which â€Å"ordinary† women influenced the development of the Arizona frontier and to what extent the conditions of this lifestyle affected their roles and opportunities. At the turn of the century, women in the West enjoyed greater freedom than their sisters in other parts of the country. Various social and economic necessities both allowed and forced women into situations that were traditionally reserved for men. Lesley Poling-Kempes states, â€Å"Liberation may have been a side effect, rather than a motivating force or premeditated goal, for women in the new society of the American West† (Poling-Kempes, 49). Women in this region generally had a better economic status, more job opportunities, and higher legal status than women in other regions (Rothschild and Hronek, xx). Historians have presented several hypotheses to explain this geographical distinction. One such theory is that the biased sex ratio (many more men were present than women) required men to be tolerant of women leading unconventional lifestyles. Another possibility is that, overall, the frontier embraced a more democratic way of life than settled areas, which in turn affected women’s rights (Rothschild and Hronek, xx).

Balance in the Administration of Justice Security

Recent American polls have suggested that Americans, in a bid to reducing terrorism threats, do not mind sacrificing some of their freedom. The choices faced are usually two; a free country which is prone to terrorist attacks, and a restricted country that is free from terrorism. These are hard choices to make, especially with the view that no restrictions can guarantee absence of a terrorist attack, they merely reduce the chances of occurrence. Some people see no conflict between security and liberty, and instead view security as a means to liberty.Proper governments use police powers, both military and domestic, to safeguard the liberty of its citizens. According to Coutu (2006), abrogation, cannot however be used to safeguard individual freedom. Governments that use police powers arbitrarily, destroy the values that they are supposed to secure. Before these governments use police powers to place people under surveillance, question them, arrest them, prosecute them, and in internat ional threats, attack enemy countries, they should have comprehensive evidence of threat to the citizens of its country.This principle is used even in times of war, although procedures and standards, of prosecution and evidence may change. For example, if a certain country supports terrorists, the government has the right to screen or ban citizens arriving from that country. During war, the government has also the right to imprison or execute enemy combatants, without public trials. The major bone of contention when balancing the needs of the justice system and the individual rights of the people, is the perception that individual rights have been trampled on, when enforcing security regulations.Such rights as freedom of movement, freedom of expression, and rights of privacy are seen to be curtailed, when enforcing security regulations, such as using torture to obtain information, monitoring phone calls to obtain information, and checking IDs when screening people. These three issue s are analyzed below, including my suggestions, as a justice administrator, on how to deal with them, so as to balance needs of the justice system and the individual rights of the people. Issues involved in regulation of security. Use of torture to obtain informationAccording to Coutu and Simon (2007), torture has long been used as a means of extracting information from suspects or prisoners. In the United States, the US army and the Central Intelligence Agency (CIA) are the most notorious government agents that have been reported to use torture in extracting information. In fact, both of them have courses on torture, in their training manuals. Torture is normally conducted in dark rooms, which have no toilets and windows, and its aim is to threaten the suspect into giving information, due to belief that lack of cooperation will lead to physical and emotional trauma.There have been many instances where the US army has been caught torturing prisoners, the most notable in the Iraqi pr isons, and Guantanamo bay, Cuba. The exposure by the media has however led to decrease in such human rights violations. In instances of war, it is difficult for soldiers to balance between the freedom of a person and security obligations. This is because a war is a life and death situation, and does not allow the leisure of thinking rationally before acting, especially when in a battle scene.However, in case prisoners are captured, in my opinion as a justice administrator, the security obligations should only outweigh individual rights, and allow reasonable level of torture, if either of three conditions are met. The prisoner should have information that is; crucial to saving lives of other people, will help in achievement of the war mission, or will help prevent further destruction of property. As stated above, reasonable level of torture should be used in these circumstances, and it must be carried out in the presence of a qualified physician.In case it is not during a war situati on, my opinion is a fourth condition is introduced; that a court of law should be convinced that there is evidence that suggests, that torture is the only means that can be used to extract that information. Monitoring phone calls to obtain security threats. According to Stephens and Glenn (2006), telephone and wire taps have been used to obtain information, by third parties, for a relatively long time. Its history can be traced to as early as 1890s and has been carried out in the US, under several presidents.Wire tapping has for many years been used to catch spies, or to spy against foreign countries with a view of obtaining strategic information. However, it has taken a different dimension recently, and is largely used to either catch criminals in the act, or to prevent crimes from happening. This involves tapping the telephones that are used or placing bugging devices close to suspects, so that they might capture their conversation. There have been calls for restriction of wire ta ps, since it is seen as violation of the right of privacy.This is especially true because of the tendency of government agents to abuse such powers, and tap phones, even where there is no accompanying evidence to suggest a crime. When deciding on the use of wire taps, it is important to weigh the security of the wider public, against the rights of the individual. In case the security threat outweighs the rights of the individual, wire taps may be used. However, before wire taps are used, in my opinion as a justice administrator, a court of law has to authorize it, and three conditions must be satisfied.The first is that, it should be proved that there is evidence against a suspect that links him or her to committing, or trying to commit a crime. The second is the alleged crime has to be material enough to warrant a wire tap. The third is that there should be no other possible way to link the suspect to the crime, other than use of a wire tap, and that the chances of its success shou ld be reasonably high. In this case, the security of the wider public will have out weighed the individual freedom, and use of phone taps will be reasonable. ID checks in screening peopleSince the September 11, 2001 attacks, there has been increase in checking of IDs, as a preventive measure against criminal activity. IDs are checked when using airlines, checking into hotels, entering a government building and sometimes even entering a hospital. These checks are all aimed at ensuring security prevails, but some people see it as invasion of privacy, and restricting freedom of movement. When trying to balance liberty and security, it is imperative that a cost benefit analysis is done, and benefits of such measures weighed against costs.In this case, checking IDs should have more benefits against costs, but that is not the case. In fact, according to Toner (2002), all the September 11 terrorist attacks were carried out by people with IDs; some were fake, others were genuine. They carri ed them since they expected to be asked for them. IDs are very easily forged, and are readily available; teenagers use them often to enter clubs when they are under-aged. IDs are also useless to check, if there is no accompanying profile; this means merely having an ID of a criminal without knowledge that he or she is one, does not have any benefit.Presence of profiles divides people into two classes; those that fit the profile and are thus screened cautiously, and those who do not fit the profile and are thus not screened very cautiously. This exposes a very dangerous third category of those who are criminals but do not fit the profile. Examples are Timothy McVeigh, the Oklahoma bomber, and John Allen, the Washington sniper. In such circumstances, it is clear that benefits of ID checks are lower than their costs, the cost being intrusion of privacy and freedom of movement.In my opinion as a justice administrator, it is important to cease such checks, since they limit freedom and li berty, without reasonable benefits on security of the wider public. The police should use other approaches such as random checks, which are less predictable than regular checks. Changes in technology and mass communication and effects on justice and security areas. The advent of globalization has turned the world into a global village. According to Waldron (2003), it is possible to carry out business activities, communicate, learn, share ideas, and so much more, with anyone in any part of the world, through the Internet.Mobile phone technology has also made it possible for people in all corners of the world to communicate and interact with one another. This is the reason that e-mails and mobile phones have played an important role in many people's lives. However, criminals have also had access to these forms of communication and interaction, which has presented a danger to the society. Technology has enabled criminals to carry out their activities faster, and with higher precision. Technology has enabled them to communicate faster amongst themselves, and obtain information about their targets.Changes in technology have also been the downfall of criminals. Through use of mobile phones and emails, criminals have left traces of their criminal activities and identities. This is because communication between themselves can be recorded, fingerprints and DNA can be ‘lifted' from crime scenes, and data can be recovered from computers and phones that they use. This has been the key to solving many crimes, since it places the suspects at the crime scene, and may unearth crucial evidence to use in prosecution. This is what investigators have relied on, over the years.New technology has enabled investigators to be able to monitor suspects' movements and communication through ‘bugs' placed on phones that record conversations and cameras that monitor movements of suspects. However, there has been cases where investigators have abused their powers, by illegally l istening to conversations of people, without evidence that they are potential suspects. This is what has been regarded by people as restricting the freedom of privacy. Mass media has played a very important role in highlighting issues regarding to liberty and security of citizens.The media has played a very important role, especially with regards to exposing human rights abuses by US soldiers, both in Iraqi prisons and Guantanamo bay, in Cuba. In both instances, the media exposed torture on unarmed prisoners, and in other cases, on non-combatants. This was previously restricted to the closed walls of prison, but once it was exposed, the abuses had to cease, due to the spotlight on the soldiers. The mass media can thus be said to have played a crucial role in restoring justice, in that respect. ConclusionIt is evident that the balance between individual rights and the administration of security is difficult. This is because some people complain, when administration of security is don e, under the guise of violation of their rights. On the other hand, when crimes are committed, they are the first ones to blame the security agencies. This makes it a very delicate affair and the administrators of justice should ensure that a balance between the two is maintained. This can be done by weighing the benefits of the administration of security to the wider public, against the rights of the individual.If the benefits to the wider public outweigh those of the individual, then the security measures should be performed. Another way of ensuring the balance of security and individual rights, especially during a war situation, is to make sure that the decision to torture someone should be guided by saving of lives, accomplishing of war objectives, or saving of property. However, it should be noted that during war, torture should be done to reasonable levels, and that a qualified physician should be present.In absence of war, torture should be approved by a court of law, after e xamining evidence presented, and ruling that torture is inevitable. In the case of phone taps, this should only be allowed after a court of law weighs evidence produced, and concludes that phone taps are the best way of obtaining evidence against the suspect, under such circumstances.
